General Conditions
The entry period for 2019's "Super Bowl $25 Cash Giveaway" (known as "Main Draw") and its accompanying "$15 Cash Giveaway" (known as "Additional Draw"), jointly known as "Promotion", begins Monday, February 4th 2019 at 6:30 pm Mountain Standard Time ("MST") and ends at 8 pm MST on Sunday, February 10th 2019 (the "Promotion Period"). Promotion is sponsored by Donna's Glorious Giveaways (hitherto referred to as "Sponsor"), a joint independent associate of Amazon.com, Blogger.com and Paypal.com ("Promotion Partners"). Sponsor's computer will serve as the official timepiece for the Promotion.
Promotion is governed by these Official Rules, as well as by the laws of the State of Ohio and applicable United States federal law, without regard to any conflicts of laws principles. Promotion is void where prohibited or restricted by law. By participating in Promotion, each entrant agrees to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to Promotion.
How To Enter Main Draw
Sponsor has posed a specific question ("Promotion Question") by posting it to all platforms upon which Sponsor holds a registered presence (the "Promotion Portal"). Potential entrants ("Prospects") have been solicited by Sponsor through invitations distributed to Sponsor's registered followers in the Promotion Portal and via paid internet marketing services. Each of these solicitations directs Prospects to at least one of the platforms of the Promotion Portal. To enter Main Draw, each potential entrant ("Prospect") must answer the Promotion Question (via one or more platforms) by commenting on the corresponding Promotion-related post on said platform(s) with a statement re the Super Bowl winner. One (1) entry per Prospect per platform is permitted for each draw, although Prospects may repeatedly change their answers to Promotion Question. Whenever this happens, all of Prospect's prior responses to Promotion Question on that specific platform automatically become voided as guesses ("Pre-Entries"). Prospect is allotted an unlimited number of Pre-Entries during Promotion. Hence the most recent Pre-Entry submitted by Prospect on a given platform will be considered to be Prospect's final entry into the applicable draw(s) for that specific platform.
How To Enter Additional Draw
Each Main Draw invitation typically includes avenues via which entries may be completed elsewhere in the Promotion Portal, or even in the wider Web ("External Promotion Area" or "EPA"). In order to enter the Additional Draw, existing Main Draw entrants must complete at least one (1) other Main Draw entry on a separate platform. Main Draw entries may be completed in the EPA by copying one of the Main Draw's links (obtained from the Promotion Portal), posting it in the EPA and answering the Promotion Question by commenting on that EPA post with a Super Bowl winner statement. As with the Main Draw, existing Additional Draw entrants may repeatedly change their answers to Promotion Question by applying the Pre-Entries provision of these Official Rules to the Additional Draw.
Bonus Entries
Entrants may earn limited bonus entries (in conjunction with those entries which they have personally submitted) by completing a given number of tasks ("Bonus Entry Tasks"). The number of bonus entries to be awarded for the completion of these tasks will be determined solely by Sponsor.
Credit for all completed Bonus Entry Tasks must and shall be awarded by Sponsor to the rightful undertakers as follows:
- 1st correct game prediction via e-mail: 10 bonus entries into Main Draw, per registered e-mail address owner
- Main Draw entry submitted from within EPA: 10 bonus entries into Additional Draw
- Person referred to Promotion by an entrant is verified by Rafflecopter widget to have also entered Promotion: 5 bonus entries into Main Draw per referrer, per verified Promotion referral
All entry requirements (and Bonus Entry Tasks) must be satisfied by 8 pm MST on Sunday, February 10th 2019. All entries must be received by 8 pm MST on Sunday, February 10th 2019. Entries received before and/or after the Promotion Period will be void. Notwithstanding Sponsor's probable need to delay shutting off the Promotion Portal immediately after the Promotion Period (due to the considerable time required to determine and extract the qualified entries for both draws), at that time Promotion would officially end and any new entries submitted thereafter would be automatically invalidated. Entries must be completed accurately and in full. All entries become the sole property of Sponsor and will not be returned.
Main Draw Notification
Only entrants with correct responses to the Promotion Question (or fully completed Bonus Entry Tasks) will go forward to final round of Main Draw. One (1) winner will be randomly selected from all eligible entrants into final round, who have answered the Promotion Question correctly via the Promotion Portal or EPA platform(s) of their choice, or who are among Sponsor’s successful Bonus Entry Task undertakers. Should there be no successful entrant to final round, Main Draw will be voided and no prizes will be awarded for it.
Additional Draw Notification
One (1) winner will be randomly selected from all eligible entrants into Additional Draw, who have followed up a Main Draw entry on a given platform with a similar entry on another platform, or who are among Sponsor’s successful Bonus Entry Task undertakers by virtue of completing at least one Main Draw entry from within the EPA. All Additional Draw entries (including e-mail entries) are eligible to win the associated prize, whether or not their corresponding answers to Promotion Question are correct.
Each winner will be alerted by e-mail or by social media notification at the e-mail address or social media handle corresponding to his/her existing mailing list or social media registration with Sponsor. Winners not registered with Sponsor will be deemed as duly notified of their wins when Sponsor posts a winners' list for Promotion on the Promotion Portal.
In the event that Main Draw has no winners, the given reason will be posted to the Promotion Portal and a new Main Draw will be devised involving all entrants from the initial round. The odds of winning are determined by the total number of eligible entries received for the duration of Promotion. All prizes legitimately claimed will be awarded.
Each winner will be required to respond to the prize notification within the time specified in said notification and will be required to provide an e-mail address registered at one of the Promotion Partners for the purpose of receiving the prize. Notwithstanding Sponsor's desire to honor winner's choice of payment medium, Sponsor reserves the right to select whichever available payment option (from amongst the Promotion Partners) is most convenient for Sponsor at the time of awarding the prize. If the above requirement is not met, the prize may be awarded to a replacement winner drawn at random from the pool of remaining eligible entries. The replacement winner will need to satisfy all of the requirements of these Official Rules. This process shall be repeated until the prize is awarded in full.
Sponsor will retain and use entrants’ contact information solely for the purposes of adhering to relevant legal requirements and for alerting them to future sweepstakes opportunities, except where prohibited by law or in cases where entrants request the purging of said contact information. At the end of Promotion Period, any entrants wishing to have their contact information purged must send a written request to Donna Mills (blogettedonna@gmail.com)
Prizes
One (1) eligible Main Draw winner will win $25 cash and one (1) Additional Draw winner shall win $15 cash. As the Main Draw and Additional Draw are separate and distinct, it is entirely possible and permissible for one (1) person to win both draws and consequently, both prizes.
One (1) prize per draw will be awarded to either the same or a different winner, who will be given the sole options of having the prize money sent to his/her/their registered e-mail address as either an electronic funds deposit (from one of the Promotion Partners) or an electronic gift card redeemable at one of the Promotion Partners. Prize is not transferable, exchangeable, or redeemable for goods or merchandise other than those found at Promotion Partners. Reporting and payment of any federal, state, provincial, local, VAT, or other taxes, fees, customs, duties, insurance, or other amounts owed in connection with any prize are the sole responsibility of the winner.
Sponsor will not replace any lost or stolen gift cards, however such a loss was caused. In the event of such an occurrence, the initial awarding of prize to the winner shall constitute full satisfaction of Sponsor’s prize obligation to said winner and no additional compensation will be awarded.
Upon accepting the gift card or funds deposit, winner may be required to sign and return an affidavit of eligibility (certifying that he/she is 18 years or older) within 21 days of notification, or an alternate winner will be selected.
EACH PRIZE IS GIVEN AWAY BY SPONSOR "AS-IS." SPONSOR DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING ANY PRIZE, INCLUDING WITHOUT LIMITATION ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Eligibility
Promotion is open to any natural person in the world, who is 18 years or older at the time of entry, and who has access to the Internet at or before 6:30 pm MST on Monday, February 4th 2019.
Officers, directors, and employees of Sponsor and/or its parents, subsidiaries, affiliates, divisions, or agents (including but not limited to advertising, promotion and production agencies) and members of their immediate families (including spouse, parents, siblings, grandparents, grandchildren, step-children, step-parents and in-laws) or those with whom they are domiciled are not eligible.
Prospects may enter Promotion multiple times, but only the most recent Promotion Question response from each Prospect, per entry platform, will be entered into the Main Draw. Prior entries from Prospects determined to be submitted as a Promotion Question response from the same entry platform or from the same individual using multiple e-mail addresses/social media handles in violation of this rule will be designated as Pre-Entries and thereby disregarded.
Late, incomplete, computer-generated script, or other automated entries are not eligible and are void. In addition, entries that have been tampered with or altered are not eligible and are void. Entries made on the Internet will be deemed made by the authorized account holder of the corresponding e-mail address/social media handle.
In the event of a dispute, the potential winner may be required to provide proof that he/she is the authorized account holder of the e-mail address/social media handle associated with the potentially-winsome entry. It is the sole responsibility of each entrant to notify Sponsor in the event of a change in e-mail address/social media handle or other contact information. Sponsor is not responsible for network, modem, or other equipment failures or for incomplete, garbled, or delayed entries, however caused.
Disqualification
Sponsor reserves the right, in its sole discretion, to disqualify any entrant that Sponsor determines: (1) has tampered with the entry process or the operation of Promotion; (2) has acted in an unsportsmanlike or disruptive manner or with the intent to annoy or harass Sponsor or any other person or entity; (3) has not satisfied all of the requirements for entry in Promotion; or (4) to be otherwise ineligible under, or otherwise in violation of, these Official Rules.
Any attempt by an entrant to commit any of the above acts of misconduct may be a violation of civil or criminal law and Sponsor reserves the right to seek damages from such entrant to the fullest extent permitted by law.
Liability/Terms and Conditions
By entering, each entrant releases and holds harmless Sponsor, any manufacturer or supplier of any prize, any other persons or entities involved in Promotion, each of its and their respective parents, subsidiaries, and affiliates, and each of its and their respective officers, directors, employees, and agents, from any responsibility or liability whatsoever arising out of or resulting from: (1) entry or participation in Promotion; (2) the acceptance, possession, or use of any prize; (3) any violation by such entrant of these Official Rules or applicable laws; (4) any incorrect or inaccurate entry of information including, but not limited to as a result of technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof; (5) entry materials that have been tampered with, or entries that are illegible, late, lost, damaged, postage due or misdirected; (6) any injury or damage to participants or any other person's computer related to or resulting from participation or downloading any material in connection with Promotion; and (7) any conditions arising from events beyond Sponsor's reasonable control.
In particular, Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.com, Twitter.com, Google+ (https://plus.google.com) or Pinterest.com (collectively known as the "External Parties").
By entering Promotion, Prospects are thus certifying their personal understanding that they are providing their information to the designer of the forms, interfaces and various entry mechanisms used throughout the Promotion Portal (i.e. Sponsor) and not to any of the External Parties.
Moreover, by entering the Promotion, entrants agree to waive any right to claim ambiguity with the Official Rules.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, NEITHER SPONSOR NOR ANY OF THE AFOREMENTIONED PARTIES SHALL BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF PROMOTION, HOWSOEVER CAUSED, WHETHER ARISING IN STATUTE, TORT, CONTRACT, OR OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER SUCH PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ALL SUCH DAMAGES ARE HEREBY DISCLAIMED AND EXCLUDED.
Publicity
By entering, each entrant grants to Sponsor the right to use and publish such entrant's name and any other information in any winning entry both online and in print, in connection with Promotion, without additional compensation, except to the extent prohibited by law. Sponsor reserves the right to use any information provided by entrants in connection with Promotion in any manner permitted by these Official Rules.
Termination
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Promotion at any time for any reason, including but not limited to any reason that affects the administration, security, fairness, integrity, or proper conduct of Promotion. Such reasons include but are not limited to fraud, tampering, unauthorized access, infections by computer virus, bugs, technical failures, or any other causes beyond the control of Sponsor.
Should Promotion ever be terminated prior to awarding of the prize(s), Sponsor will announce an alternate means of awarding the prize(s) on the Promotion Portal.
No Endorsement
Nothing contained in these Official Rules or in any of the Promotion materials should be construed as an endorsement by Sponsor of any prize manufacturers or suppliers or other third party, product, or service.
Winners' List
Other than referring to the Promotion Portal after end of Promotion Period, a personal copy of the winners’ list and/or of these Official Rules may be obtained by e-mailing Donna Mills (blogettedonna@gmail.com).
